PACIFIC RADIATOR LTC STANDARD TERMS AND CONDITIONS

TERMS:
All sales will be made on a cash or C.O.D.basis unless credit has been established by completing a PACIFIC RADIATOR MFG. credit application duly notarized. All invoices are due net 10 days after the end of the month of purchase (in accordance with accepted payment terms). A service charge of 2% per month, 26.8 % per annum, will be charged after payment has come due. This is not to be construed as an interest charge - it is to reimburse Pacific Radiator Mfg. for carrying, maintaining, and collection costs.
FREIGHT:
All shipments are made F.O.B. point of origin via shipper’s choice of common carrier.

TITLE:

Title to merchandise passes to the purchaser on delivery to the carrier. PACIFIC RADIATOR MFG. carefully boxes and crates all merchandise in accordance with the approval of the transportation company delivering to you. They accept the responsibility that the merchandise will be delivered in good order. This responsibility is impossible for us to accept, therefore DO NOT ACCEPT SHIPMENTS UNLESS THEY ARE IN PERFECT CONDITION or unless you make notation of damages on the carrier’s receipt and then file a claim immediately with the transportation company.

Should the damage be discovered later, or is unseen until unpacked, call the transportation company and they will make an inspection and, when warranted, will approve an unseen or concealed damage claim. Unless the foregoing is adhered to, all claims must be at your own expense. If you have trouble having your claim adjusted, advise us and we will assist you.

RETURN OF MERCHANDISE:
Only stock items are returnable and only if less than 1 year old and in salable condition. No returns on specials (non catalogue items). There is a restocking charge of 15%. All returns MUST BE PREPAID and accompanied with a copy of the invoice or a packing slip with the original invoice number.

TERMS OF WARRANTY:

Pacific Radiator Mfg. Ltd. (PRM) warrants its passenger and light truck complete radiators and replacement cores to be free of defects in material and workmanship for a period of 12 months from date of sale to the first retail purchaser. Also, PRM warrants its industrial complete radiators and replacement cores (including automotive cores used in an industrial or commercial application) to be free of defects in material and workmanship for a period of 6 months from the date of the first retail purchase. This warranty covers any parts furnished by, and/or distributed by, Pacific Radiator Mfg Ltd. but DOES NOT INCLUDE LABOUR OF ANY KIND OR MATERIALS NOT FURNISHED BY PACIFIC RADIATOR MFG or any charges for such labour and materials.

PRM products are intended to be installed by professional repair personnel only and are not intended for general sale to the public in the uninstalled condition. Failure to follow this provision voids all warranties.

THIS WARRANTY DOES NOT APPLY TO COMPLETE RADIATORS OR CORES THAT HAVE BEEN:

1. Altered outside PRM factories in any way as to, in the judgment of PRM, negatively affect the performance and or function.
2. Subjected to abuse, misuse, negligence or operating conditions in excess of those specified by the OEM.
3. Installed by someone other than professional repair personnel.

This warranty does not cover the physical or chemical effects of water, steam or other liquids, gases or agents present in the system or operating environment of the equipment.

Claims for engine damage caused by overheating will be denied. Warning lights or gauges are provided in all vehicles in order to warn operators of overheating conditions long before engine damage occurs. PRM is not responsible for radiator damage due to operating negligence.
This limited warranty is extended to, and is enforceable by, only the first retail purchaser, and in lieu of all other warranties expressed or implied including warranties implied by law and warranties of merchantability and fitness. PRM will not be responsible for incidental or consequential damages of any kind resulting from the purchase or use of its products. All warranty claims must be made by the first retail purchaser at the original place of purchase with a valid proof of purchase and professional installation within 6-12 months of the date of sale to the first retail purchaser. Purchaser’s remedy shall be limited to repair or replacement of any part or parts which, upon examination, PRM finds to be defective. Purchaser’s remedy does not include any labour, material or transportation charges for removal, replacement, installation or other work or services performed.

This warranty gives you specific legal rights and you may have other rights, which vary from province to province and state to state. Some areas do not allow limitations or implied warranties and/or limitations on incidental or consequential damages so some of the limitations above may not apply to you.
